Code of Ethics

Respect for users is the key to a lasting relationship. It is all too easy for today's customers to sever the link they have with you, complaining about commercial pressure being exercised and lack of relevance in the offers they receive.
Cabestan encourages clients to remain mindful of two things:

  • the necessary transparency towards customers
  • the required respect for the legal framework

Cabestan requires all Customers to comply with the following legal requirements established for commercial email service providers: CAN SPAM Act of 2003, the Directive 2000/31/EC of the European Parliament and Council of 8 June 2000, on legal aspects of information society services, in particular, electronic commerce in the Internal Market ('Directive on Electronic Commerce'), along with the Directive 2002/58/EC of the European Parliament and Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector ('Directive on Privacy and Electronic Communications') and laws in force of Customer's country of residence.

In the event that you have received an unsolicited message from one of our clients through the use of one of our solutions, we would be grateful if you could inform us by sending the sender's name and the subject line text of the message received to: Your complaint will be immediately dealt with and forwarded to the client concerned, and your email address will be completely removed from our database.


opt-in database

Cabestan specifies that the email addresses used must have been collected via 'opt-in', implying the user's explicit consent to receiving email. Cabestan also urges its clients to advocate the double opt-in principle: a request to sign up to a newsletter does not become effective until the user has clicked on a link in an email.

Cabestan forbids email being sent to addresses obtained by purchasing a CD-ROM.

Cabestan does not own the databases. All databases used on the mailing platform are the property of our clients or of companies specialising in list rental.


Unsubscribe link

Cabestan automatically ensures that each email sent from the platform contains a visible and active unsubscribe link. Unsubscribers are automatically excluded from future mailings.


Access to data

Cabestan encourages its clients to provide users with a profile update form enabling them to see the data concerning them that is hosted on the platform. This data can be displayed and modified.


Message content

The content of email hosted by Cabestan must not contain information of a sexual, defamatory or racist nature.

Any failure to observe the obligations set out above may lead to access to the platform being denied. Cabestan will systematically carry out an audit of your database before engaging in a collaboration.

Cabestan is an active member of the SNCD (National Union of Direct Communication) for France and the MAAWG internationally.
